第１７回五庁長官会合の開催

２０２４年６月２０日に、日本国特許庁（ＪＰＯ）、米国特許商標庁（ＵＳＰＴＯ）、欧州特許庁（ＥＰＯ）、中国国家知識産権局（ＣＮＩＰＡ）および韓国特許庁（ＫＩＰＯ）の間にて、第１７回五庁長官会合が開催された。また、当該第１７回五庁長官会合に先駆けて、その前日の２０２４年６月１９日には、五庁長官・ユーザー会合が開催された。

前記第１７回五庁長官会合では、持続可能なイノベーションに向けた包括的な知財システムの構築をテーマに、主に中小企業の成長を促進するための知財の役割と、当該分野における五庁の協力の在り方について議論された。

なお、前年に実施された第１６回五庁長官会合では、ＡＩ関連発明に係る五庁の審査実務に関して、ＪＰＯが主導して作成した五庁の法律・審査基準・審査事例等をまとめた比較表が承認された。また、前記第１６回五庁長官会合では、以下に示す新たな五庁ビジョンが合意された。

「包括的でアクセスしやすい特許制度を通じてイノベーションと経済成長を促進し、持続可能な未来を築く。制度運用調和、質の高いタイムリーな調査及び審査結果、ワークシェアリング、特許情報へのアクセスの提供を通じて特許保護を促進し、効率的で費用対効果が高くユーザーフレンドリーな国際的特許環境を実現する。」

一方、前記第１７回五庁長官会合では、前記比較表の中の、審査事例部分をより詳細に分類した新しい比較表が承認された。また、前記新たな五庁ビジョンの実現に向けて、「持続可能な未来を築くための指針」を今後策定し、中長期的に取り組んでいくことに合意がされた。

加えて、前記五庁長官・ユーザー会合では、中小企業支援に関する五庁と五庁ユーザー団体との連携の強化について意見交換が行われた。

前述の事項から、前記五庁にて、今後、特に、中小企業支援に関する取り組み、および、ＡＩ関連発明の審査に関する取り組みが、さらに進められていくと考えられる。

ドイツ特許商標庁（ＤＰＭＡ）および韓国特許庁（ＫＩＰＯ）との審査官協議

日本国特許庁（ＪＰＯ）は、２０２４年５月２０日から２４日にかけて、韓国特許庁（ＫＩＰＯ）との間にて、審査官協議を行った。また、ＪＰＯは、２０２４年６月１０日から１４日にかけて、ドイツ特許商標庁（ＤＰＭＡ）との間にて、審査官協議を行った。

「審査官協議」は、海外知財庁審査官との互いの先行技術文献調査の手法や審査実務等についての議論を通じて、信頼感を醸成し相互理解を深化させ、先行技術調査結果・審査結果の相互利用等の推進を図る取り組みである。

ＪＰＯは、海外知財庁との間にて継続的に、審査官協議を行っており、ＫＩＰＯとの間およびＤＰＭＡの間において、２０００年から継続的に審査官協議を行ってきた。

今回の審査官協議では、ＫＩＰＯとの間では光デバイス（エレクトロルミネッセンス光源）分野にて、および、ＤＰＭＡとの間では自然資源（住環境）および医療機器（治療機器）分野にて、両庁共通の特許案件の協議を行うとともに、先行技術文献調査の手法や審査基準の運用などの情報交換が行われた。

今後は、光デバイスの分野において、日本および韓国のそれぞれにて同一の発明について特許出願を行う場合に、ＪＰＯおよびＫＩＰＯは同様の見解を示し、同様の内容で特許される可能性があると考えられる。同様に、自然資源および医療機器の分野において、日本およびドイツのそれぞれにて同一の発明について特許出願を行う場合に、ＪＰＯおよびＤＰＭＡは同様の見解を示し、同様の内容で特許される可能性があると考えられる。

Ｆタームの改定情報

特許庁では、特許文献を技術範囲ごとに区分する「Ｆターム」が作成され、審査の際の国内特許文献のサーチキーとして利用されている。前記「Ｆターム」は技術の進展に対応し適切なサーチキーとして機能するように、必要に応じてメンテナンスが行われてきた。前記メンテナンスの具体的な内容としては、テーマ統合・分割およびＦタームリスト再作成等のテーマの改正、並びに、新規テーマの作成およびＦタームテーマのＦＩテーマ化等に伴う新規文献のＦターム解析の停止、などが挙げられる。

メンテナンスされた「Ｆターム」について、メンテナンス前のＦタームが付与された公報発行済み文献に対し、新たなＦタームを再付与することによって、再解析が実施される。よって、メンテナンスされた「Ｆターム」に関する分野において、Ｆタームを用いた検索を行う際には注意が必要である。

今回、２０２４年６月１２日に、メンテナンスされ、再解析中のＦタームが公表された。再解析中の主なＦタームは、以下に示す通りである。

17th IP5 Heads of Office Meeting

On June 20, 2024, the 17th IP5 Heads of Office Meeting was held between the Japan Patent Office (JPO), the United States Patent and Trademark Office (USPTO), the European Patent Office (EPO), the China National Intellectual Property Administration (CNIPA), and the Korean Intellectual Property Office (KIPO). A meeting of the IP5 Heads of Office with IP5 Industry was held one day earlier on June 19, 2024 as a precursor to the 17th IP5 Heads of Office Meeting.

At the aforementioned 17th IP5 Heads of Office Meeting, under the theme of building a comprehensive IP system for sustainable innovation, the main topic of discussion was the role of IP in promoting the growth of SMEs and the nature of cooperation in this area among the five offices.

At the 16th IP5 Heads of Office Meeting held last year, a comparative table of laws, examination standards, examination cases, etc. of the five offices with regard to their examination practices for AI-related inventions, which had been prepared on the JPO’s initiative, was approved. In addition, at the 16th meeting, the following new vision for the five offices was agreed upon.

“Building a sustainable future by fostering innovation and economic growth through an inclusive and accessible patent system. Promoting patent protection through harmonization of practices and procedures, high-quality and timely search and examination results, worksharing and access to patent information and achieving an efficient, cost-effective and user-friendly international patent landscape.”

Meanwhile, the aforementioned 17th IP5 Heads of Office Meeting approved a new comparative table in which the section on examination case studies of the aforementioned comparative table is classified in more detail. It was also agreed that “Guidelines for Building a Sustainable Future” will be formulated in the future to realize the aforementioned new vision of the five offices and to work on it in the mid- to long-term.

In addition, at the aforementioned meeting of the IP5 Heads of Office with IP5 Industry, opinions were exchanged on strengthening cooperation between the five offices and the IP5 user groups regarding support for SMEs.

Based on the above, it is expected that the five offices will make further efforts to support small and medium-sized enterprises and to examine AI-related inventions in particular in the future.

Examiner consultations with the German Patent and Trademark Office (DPMA) and the Korean Intellectual Property Office (KIPO)

The Japan Patent Office (JPO) held examiner consultations with the Korean Intellectual Property Office (KIPO) from May 20 to 24, 2024. The JPO also held examiner consultations with the German Patent and Trademark Office (DPMA) from June 10 to 14, 2024.

The “Examiner Consultation” is an initiative to promote mutual use of prior art search and examination results, etc. by fostering a sense of trust and deepening mutual understanding through discussions with examiners of overseas IP offices regarding each other’s prior art document search methods and examination practices, etc.

The JPO has been continuously consulting with examiners at overseas IP offices, and has held examiner consultations with the KIPO and the DPMA continuously since 2000.

During the Examiners’ Meetings, the two offices discussed common patent cases – with the KIPO in the field of optical devices (electroluminescent light sources) and with the DPMA in the fields of natural resources (living environment) and medical devices (therapeutic devices) – and exchanged information on methods of prior art document searches and the operation of examination standards.

In the future, it is likely that the JPO and KIPO will take a similar view and might grant patents for the same contents in the field of optical devices when the same invention is filed in Japan and Korea, respectively. Similarly, if the same invention in the fields of natural resources and medical devices is filed in Japan and Germany, it is expected that the JPO and the DPMA will take a similar view and might grant patents for the same contents.

F-term Revision Information

The JPO has created “F-terms”, which classify patent documents by technical scope, and are used as search keys for domestic patent documents in the examination process. The “F-terms” have undergone maintenance as necessary in response to technological developments so that they may continue to function as appropriate search keys. The specific contents of the aforementioned maintenance includes theme revisions such as theme merging, splitting, and F-term list re-creation, as well as the suspension of F-term analysis of new literature due to the creation of new themes and the conversion of F-term themes into FI themes, etc.

For a maintained “F-term,” reanalysis is performed by reassigning a new F-term to the published literature to which the pre-maintenance F-term was assigned. Therefore, care should be taken when conducting searches using F-terms in fields related to the maintained “F-terms”.

The F-terms that have been maintained and are being reanalyzed were published on June 12, 2024. The main F-terms under reanalysis are listed below.
