Bill for revising Korean Patent, Trademark, and Design Protection Acts passes through plenary session of the Diet, to relieve applicant's negligence and enlarge opportunity of obtaining IP rights

On September 29, 2021, the Korean Intellectual Property Office (KIPO) announced that a bill for partial amendments to the Korean Patent Act, etc., had passed through the plenary session of the Diet. The bill is aimed to positively relieve negligence caused by applicants having weak foundations for intellectual property (IP) rights, such as individuals, and small and medium-scaled enterprises, and ultimately to secure the greatest possible opportunity of acquiring IP rights.

The amendment acts are set to be promulgated in October, and are scheduled to come into force as from the day on which 6 months from the day of promulgation have elapsed.

The legislative revision will extend a period for requesting an appeal against a decision of refusal from 30 days under the current acts, to 3 months.

The legislative revision will also ease requirements for restoring rights extinguished due to a failure to submit a process document or to pay a fee.
